Chapter 11 of the Bankruptcy code is a “reorganization”, and is primarily used for businesses or individuals with large assets/debts that don’t fall under the Chapter 13 filing requirements.
In some cases, even an individual debtor who could file under Chapter 13, may choose to file a Chapter 11 because of the expanded options and flexibility that are available with a Chapter 11 filing. The decision on which Chapter of the bankruptcy code is the right one for you is very important, and you should consult with a qualified and experienced bankruptcy attorney.
The goal of a Chapter 11 reorganization is to have the creditors, and ultimately the Court, approve a plan of reorganization. This is often a long and complicated process. Various creditors may have competing or different interests, and seeing a Chapter 11 Reorganization through to a successful end requires planning and experience.
Mr. Baker has extensive legal experience in Bankruptcy. He has represented debtors, creditors, and has been a court appointed Chapter 11 Trustee.
Chapter 11 Bankruptcy filings can be extremely complicated, and are highly customized. It is important that you choose a qualified attorney, and we encourage you to schedule a consultation with Mr. Baker to discuss your specific circumstances.
